By accessing or using projectbroadsheet.com (this "Site"), you agree to these Terms of Use. If you don't agree, please don't use the Site.
1. The Site
This Site is operated by Jon Ajinga, doing business as Pikes Peak Web Designs ("we," "us," "our"). You may browse and use the Site for any lawful purpose.
2. The software
Project Broadsheet — the framework referenced throughout this Site — is distributed under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the software. You don't need our permission. You don't have to attribute us (though we appreciate it).
The MIT License is the governing legal instrument for the software. These Terms of Use apply to this website only.
3. Paid services
Any paid engagement (launch packages, content migration, care plans, custom development, training) is governed by a separate written scope and proposal. Before any paid work begins, we'll send:
- A written statement of work
- A fixed-fee estimate (or hourly cap)
- A schedule of deliverables
- Payment terms and refund policy
Accepting a proposal in writing (email is fine) creates the engagement agreement.
4. Acceptable use
Don't use this Site to:
- Violate any law or regulation
- Harass, defame, or threaten anyone
- Send spam, viruses, or malicious code
- Attempt to breach the Site's security, probe for vulnerabilities, or bypass rate limits
- Scrape content for commercial republication without permission
- Impersonate us, our employees, or any other person
We reserve the right to block IPs or users who violate these rules.
5. Your submissions
When you submit content through a form on this Site (a message, bug report, feature request, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use that content for the purpose of responding, improving the product, or including it (anonymized) in our documentation or marketing.
Don't submit confidential, privileged, or highly sensitive information through our forms. If you need to share something sensitive, email us first and we'll arrange an encrypted channel.
6. Third-party content and links
This Site links to third-party services (GitHub, Buttondown, Cloudflare, etc.) and reproduces third-party names for comparison and documentation purposes. We don't control those services, and their use is governed by their own terms.
Third-party trademarks (Ghost, Substack, WordPress, etc.) are the property of their respective owners. Use of these names is descriptive and does not imply affiliation or endorsement.
7. Disclaimer of warranties
The Site and the Project Broadsheet software are provided "as is" and "as available," without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or software will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from your use of the Site or software, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site will not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or software.
10. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in El Paso County, Colorado, and you consent to personal jurisdiction there.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced on the Site. Your continued use after changes means you accept the revised Terms.
12. Entire agreement
These Terms, together with our Privacy Policy and Accessibility Statement, constitute the entire agreement between you and us regarding the Site.
